はじめに / Introduction

この利用規約（以下「本規約」）は、株式会社ReFlow（以下「当社」）が提供するBreatheFreeアプリ（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロード、インストール、または使用することにより、お客様は本規約に同意したものとみなされます。本規約に同意いただけない場合は、本アプリをご利用いただけません。

These Terms of Service ("Terms") govern your use of the BreatheFree app ("the App") provided by ReFlow Inc. ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

1. サービスの説明 / Description of Service

本アプリは、禁煙を目指すユーザーを支援するためのツールです。以下の機能を提供します。

The App is a tool designed to assist users in their journey to quit smoking. We provide the following features:

• 禁煙からの経過時間・日数の表示 / Display of time elapsed since quitting
• 節約金額の計算と表示 / Calculation and display of money saved
• 健康回復のマイルストーン表示 / Health recovery milestone tracking
• 呼吸法エクササイズ（14種類以上） / Breathing exercises (14+ types)
• 日記機能（気分・渇望レベルの記録） / Diary function (mood and craving level recording)
• 禁煙バッジ・達成機能 / Quit-smoking badges and achievements
• 通知・リマインダー機能 / Notifications and reminders
• 欲求トラッキング / Craving tracking

当社は、予告なく機能の追加、変更、削除を行う権利を留保します。

We reserve the right to add, modify, or remove features without prior notice.

2. 利用資格 / Eligibility

本アプリをご利用いただくには、以下の条件を満たす必要があります。

To use the App, you must:

• 18歳以上であること / Be at least 18 years old
• 本規約に同意すること / Agree to these Terms
• 有効なApple IDまたはGoogleアカウントを保有していること（有料機能利用の場合） / Have a valid Apple ID or Google account (for paid features)

18歳未満の方が本アプリを利用することは禁止されています。

Use of the App by anyone under 18 is prohibited.

3. 免責事項（重要） / Disclaimer (Important)

医療に関する免責 / Medical Disclaimer

本アプリは医療機器ではなく、医療アドバイス、診断、治療を提供するものではありません。 本アプリは、医師、薬剤師、その他の医療専門家によるアドバイスの代替となるものではありません。

The App is not a medical device and does not provide medical advice, diagnosis, or treatment. The App is not a substitute for professional medical advice from a doctor, pharmacist, or other healthcare provider.

禁煙に関する医学的なご相談は、必ず医師または専門家にお問い合わせください。禁煙補助薬（ニコチンパッチ、禁煙外来など）のご利用については、医師にご相談ください。

Please consult a doctor or specialist for medical questions about quitting smoking. Consult a physician regarding smoking cessation aids (nicotine patches, quit-smoking clinics, etc.).

結果の保証なし / No Guarantee of Results

当社は、本アプリの使用により禁煙が成功すること、または特定の結果が得られることを保証しません。禁煙の成功は、個人の意志、健康状態、その他の要因に依存します。

We do not guarantee that using the App will result in successful smoking cessation or any specific outcome. Success depends on individual willpower, health conditions, and other factors.

健康情報について / Health Information

本アプリに表示される健康回復の指標は、一般に公開されている禁煙の健康効果に関する情報に基づく目安であり、個人の健康状態を反映するものではありません。

Health recovery indicators displayed in the App are estimates based on generally published information about the health effects of quitting smoking and do not reflect individual health conditions.

4. サブスクリプション（自動更新サブスクリプション） / Subscription (Auto-Renewable Subscription)

本アプリは一部機能を有料で提供しています。

The App offers some features as paid services.

無料トライアル / Free Trial

• 期間：4週間 / Duration: 4 weeks
• 全機能にアクセス可能 / Full access to all features
• トライアル期間中にキャンセル可能 / Can be canceled during trial period

プレミアム機能の内容 / Premium Features Included

• 呼吸法の全解放（14種類以上） / All breathing exercises unlocked (14+ types)
• 詳細分析 & 全履歴 / Advanced analytics & full history
• iCloud同期 / iCloud sync
• 広告なし / Ad-free experience
• 全テーマの解放 / All themes unlocked

料金と期間 / Pricing and Duration

• 料金はアプリ内の購入画面に表示された通りです / Pricing is as displayed on the in-app purchase screen
• サブスクリプション期間は各プランの表示に従います / Duration follows each plan's display

支払い / Payment

• お支払いはApple IDアカウントまたはGoogleアカウントに請求されます / Payment is charged to your Apple ID or Google account
• 当社はクレジットカード情報を直接取得・保存しません / We do not directly collect or store credit card information

自動更新 / Auto-Renewal

• 無料トライアル終了後、自動的にサブスクリプションが開始されます / Subscription begins automatically after free trial ends
• サブスクリプションは自動更新されます / Subscription auto-renews
• 更新日の24時間前までにキャンセルしない限り、継続して課金されます / Charges continue unless canceled 24 hours before renewal
• 更新時の料金は、サブスクリプション購入時と同額が請求されます / Renewal is charged at the same rate

管理・解約方法 / Management and Cancellation

• iOS: 「設定」→「Apple ID」→「サブスクリプション」から管理・解約できます / Manage or cancel in Settings → Apple ID → Subscriptions
• Android: Google Playストア →「定期購入」から管理・解約できます / Manage or cancel in Google Play Store → Subscriptions
• 重要: アプリをアンインストールしただけではサブスクリプションは解約されません / Important: Uninstalling the app does NOT cancel your subscription

購入の復元 / Restore Purchases

• デバイスの変更後やアプリの再インストール後は、アプリ内の「購入を復元」ボタンから以前の購入を復元できます / After changing devices or reinstalling the app, use the "Restore Purchases" button to recover previous purchases

返金ポリシー / Refund Policy

• サブスクリプションの返金については、Apple Inc.またはGoogle LLCのポリシーに従います。当社は直接返金を行うことはできません。/ Subscription refunds are subject to Apple Inc.'s or Google LLC's policies. We cannot process refunds directly.

5. 広告の表示 / Advertisements

本アプリには、Google AdMobによる広告が表示されます（プレミアムプランをご利用の場合を除く）。広告の内容は第三者の広告主によるものであり、当社はその内容について責任を負いません。

The App displays advertisements via Google AdMob (except for Premium Plan subscribers). Ad content is provided by third-party advertisers, and we are not responsible for such content.

広告のパーソナライズを無効にしたい場合は、デバイスの設定から広告のトラッキングを制限できます。

To disable ad personalization, you can limit ad tracking through your device settings.

6. 禁止事項 / Prohibited Actions

ユーザーは以下の行為を行ってはなりません。

Users must not:

• 本アプリの逆コンパイル、逆アセンブル、リバースエンジニアリング、その他ソースコードの解析 / Decompile, disassemble, reverse engineer, or otherwise analyze source code
• 本アプリの改変、二次的著作物の作成 / Modify the App or create derivative works
• 本アプリの再配布、レンタル、リース、貸与 / Redistribute, rent, lease, or lend the App
• 法令または公序良俗に違反する行為 / Violate laws or public order and morals
• 当社または第三者の知的財産権、プライバシー権、その他の権利を侵害する行為 / Infringe on intellectual property, privacy, or other rights
• 本アプリの不正利用、悪用、またはセキュリティ機能の回避 / Misuse, abuse, or circumvent security features
• 虚偽の情報の登録 / Register false information
• 当社のサービス運営を妨害する行為 / Interfere with our service operations

7. 知的財産権 / Intellectual Property

本アプリに関するすべての知的財産権（著作権、商標権、特許権、意匠権、ノウハウを含むがこれらに限られない）は、当社または正当な権利者に帰属します。

All intellectual property rights in the App (including but not limited to copyrights, trademarks, patents, designs, and know-how) belong to us or our rightful licensors.

本規約は、本アプリに関するいかなる知的財産権もお客様に譲渡するものではありません。お客様には、本規約に従って本アプリを使用する非独占的、取消可能、譲渡不能なライセンスのみが付与されます。

These Terms do not transfer any intellectual property rights to you. You are granted only a non-exclusive, revocable, non-transferable license to use the App in accordance with these Terms.

8. 責任の制限 / Limitation of Liability

法律で許容される最大限の範囲において：

To the maximum extent permitted by law:

• 当社は、本アプリの使用または使用不能から生じるいかなる損害（直接的、間接的、特別、偶発的、結果的損害を含む）についても責任を負いません / We are not liable for any damages arising from use or inability to use the App
• 当社は、本アプリの中断、エラー、バグ、セキュリティ侵害について責任を負いません / We are not responsible for interruptions, errors, bugs, or security breaches
• 当社は、本アプリを通じて得られた情報の正確性、完全性を保証しません / We do not guarantee the accuracy or completeness of information obtained through the App
• 当社の責任は、いかなる場合も、お客様が当社に支払った金額を超えないものとします / Our liability shall not exceed the amount you have paid to us

一部の法域では上記の制限が許容されない場合があり、その場合は適用法に従います。

Some jurisdictions do not allow these limitations, in which case applicable law shall apply.

9. 補償 / Indemnification

お客様は、以下に起因または関連して当社が被ったすべての請求、損害、費用（合理的な弁護士費用を含む）について、当社を補償し、免責することに同意します。

You agree to indemnify and hold us harmless from any claims, damages, and expenses (including reasonable attorney fees) arising from or related to:

• お客様による本規約の違反 / Your violation of these Terms
• お客様による本アプリの使用 / Your use of the App
• お客様による第三者の権利侵害 / Your infringement of any third-party rights

10. サービスの変更・終了 / Service Changes and Termination

当社は、以下の権利を留保します。

We reserve the right to:

• 予告なく本アプリの機能を変更、追加、削除すること / Change, add, or remove App features without notice
• メンテナンスのため本アプリを一時的に停止すること / Temporarily suspend the App for maintenance
• 当社の判断により本アプリの提供を終了すること / Discontinue the App at our discretion
• 本規約に違反したユーザーのアクセスを制限または終了すること / Restrict or terminate access for users who violate these Terms

サービス終了の場合、可能な限り事前に通知いたします。

We will provide advance notice of service termination where possible.

11. 規約の変更 / Changes to Terms

当社は、必要に応じて本規約を変更することがあります。重要な変更がある場合は、アプリ内で通知いたします。変更後も本アプリを継続してご利用いただいた場合、変更後の規約に同意したものとみなします。

We may change these Terms as necessary. We will notify you of significant changes through the App. Your continued use of the App after changes constitutes acceptance of the updated Terms.

変更に同意いただけない場合は、本アプリの使用を中止し、アンインストールしてください。

If you do not agree to the changes, please stop using the App and uninstall it.

12. 分離可能性 / Severability

本規約のいずれかの条項が無効または執行不能と判断された場合でも、その他の条項は引き続き有効に存続します。無効または執行不能な条項は、当該条項の趣旨に最も近い有効な条項に置き換えられるものとします。

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. 準拠法・管轄 / Governing Law and Jurisdiction

本規約は日本法に準拠し、日本法に従って解釈されます。本規約に関連する紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms are governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
